These terms and conditions apply to the use of online services/coaching – hereinafter referred to as "Services" – provided by Eva Hinterleitner – hereinafter referred to as "Provider". By using/ordering the Services, the contracting party agrees to these terms and conditions.
The prices, price quotes, and descriptions listed do not constitute an offer and may be withdrawn or modified by the provider at any time before express acceptance of your order. Although the provider strives to ensure the availability of the services shown, it cannot guarantee that all services will be available at the time of ordering. Should the provider be unable to process or fulfill the customer's order, the provider may reject it without further liability. In this case, the provider will inform the customer and refund any payments already made for the product. An order placed by the customer constitutes an offer to the provider to participate in the service selected by the customer under these terms of use. All orders placed by the customer are subject to subsequent acceptance by the provider. Orders for a service are placed via the registration form provided on the website. The provider only effectively accepts the offer, and the contract is only concluded, when the provider has sent the access information to the customer.
Under the terms of the user agreement and the following provisions, the contracting party receives a simple, non-transferable right to participate in the ordered service, limited to the duration of the user agreement. This right to participate during the contract period includes access to the service and, where applicable, the right to retrieve (online) learning content for the contracting party's own learning purposes. Participation is limited to the contracting party. The retrieved documents may only be used by the contracting party for their own use during the usage period. Any commercial distribution, in particular the sale, rental, leasing, or lending of services, their content, or documents, is prohibited. It is not permitted to collect and reproduce elements from the services for unauthorized use by third parties.
The content provided by the provider is protected by copyright. All rights arising therefrom, in particular the rights of reprinting, translation, reproduction by photomechanical or similar means, storage and processing using electronic data processing systems, or distribution via computer networks – even in part – are exclusively reserved to the provider. The contractual partner receives no ownership or exploitation rights whatsoever to the provided content or programs.
The fee payable by the contracting party for participation in a service is specified in the service description. Payment for participation in a service is due in advance. After registration, the participant receives an automatic confirmation from the registration portal. Registrations are processed in the order they are received. The recipient specified in the registration will receive an invoice for their registration(s). The participation fee, plus applicable VAT, is payable immediately.
All individuals who submit a registration via the registration portal as consumers (B2C) have a right of withdrawal for online purchases under the EU Distance Selling Directive (Consumer Protection Act and Distance Selling Act). We grant a withdrawal period of 14 days. Saturdays, Sundays, and public holidays are included in this period. The withdrawal period begins on the day the contract is concluded. By concluding the contract, the consumer acknowledges that the right of withdrawal expires upon fulfillment of the contract.
Registration is binding once confirmed in writing by the provider. There is no right to participate in services with limited capacity. The provider reserves the right to cancel a scheduled service due to insufficient enrollment or speaker illness. In this case, any participation fees already paid will be refunded; no further claims can be made.
The data you provide will be stored electronically in accordance with data protection laws. More information can be found on our privacy policy page.
The place of performance and jurisdiction for all claims and legal disputes arising from the contractual relationship is Vienna.
